At its meeting of 12 May 2021, the Federal Council took note of the report on the creation of a legal basis in the VAT Act, according to which legal entities subject to entry in the commercial register are systematically reported to the commercial register authorities.

With the proposed solution, the FTA will notify the commercial register authorities if a sole proprietorship not entered in the commercial register has declared an annual turnover of CHF 100,000 or more to the FTA without providing specific turnover figures. Such a reporting obligation is to be carried out via the UID register maintained by the Federal Statistical Office and a feature that can be viewed by commercial registry authorities.

The FDF will prepare a consultation draft by summer 2022. More information can be found here.
