At its meeting on 17 October 2018, the Federal Council decided to extend the exchange of country-specific reports to other states. It also adopted an amendment to the Regulation concerning the international automatic exchange of country-specific reports by multinational corporations (ALBAV).

The legal basis for the exchange of country-specific reports came into force for Switzerland on 1 December 2017. On the same day, Switzerland notified the OECD of the 108 countries with which it will exchange country-specific reports. These are all countries that have signed the Multilateral Arrangement of Competent Authorities on the Exchange of Country Reports (ALBA Agreement) or that were members of the Inclusive Framework on BEPS on 1 December 2017.

Since other countries have signed the ALBA agreement or joined the Inclusive Framework on BEPS since 1 December 2017, the Federal Council decided at its meeting on 17 October 2018 to submit an updated list of countries to the OECD in December 2018. At the time of submission, the list should contain all countries that fulfil the above-mentioned criteria.

Furthermore, the Federal Council has decided to amend the Ordinance on the International Automatic Exchange of Country-Specific Reports by Multinational Corporations of 29 September 2017 (ALBAV) because the current ordinance refers in Art. 2 to the OECD guidelines of 6 September 2017. In the meantime, these guidelines have been supplemented and revised with further technical answers for the preparation and exchange of country-specific reports. The amendment enters into force on 1 December 2018.
