At its meeting on February 14, 2024, the Federal Council opened the consultation process for a new regulation regarding the delivery of A Mail Plus consignments at weekends.
Swiss Post has been offering the A Mail Plus shipping method for some time now. This means that consignments can also be tracked and delivered on Saturdays. With the new regulation, consignments that trigger a deadline are only deemed to have been delivered on the next working day.
With motion 22.3381 "Harmonization of the calculation of time limits", the RK-N instructed the Federal Council to transfer the solution of fictitious service found for the ZPO to all other federal enactments that also contain rules on the calculation of time limits. This is intended to ensure that the same rules for the service of notices setting deadlines apply throughout federal law. Harmonization requires the amendment of various federal laws. In particular, the Administrative Procedure Act (APA), the Federal Supreme Court Act (FSCA), the Federal Act on Deadlines on Saturdays and the Federal Direct Federal Tax Act (FDTA) are to be amended.
The consultation will last until May 24, 2024.
